Abstract



Free movement of capital is one of the fundamental market freedoms of the European Union. Article 56 is the anchor provision of this market freedom in the European Community treaty. This chapter analyzes the scope and meaning of this provision in the light of the jurisprudence of the European Court of Justice and the relevant literature.
