In 2020, a deepfake video of Tom Cruise teeing off on a golf course was released on TikTok. This video provoked deep ‘terror’ in the heart of Washington national security and intelligence circles, due to its sophistication and its ability to fool the best of deepfake-detection technology.
The creation of deepfakes through AI technology provokes many interesting and challenging issues when considered in the context of copyright laws. This presentation will discuss such issues, which include the application of current copyright law to the creation of deepfake videos, whether authorship can be found to subsist using AI processes, the issue of infringement, and whether fair dealing might apply. Moral and performers’ rights issues will also be raised.
