This presentation examines the copyright challenges in Australian law which are posed by generative AI, using ChatGPT as a case study. Generative AI is technology which is capable of producing text, images or audio from training data and it has already significantly impacted multiple domains, while augmenting human creativity and problem-solving. This technology holds promise for improving various aspects of life, however, there remain significant concerns. These include ethical and social issues regarding misuse, the promotion of misinformation/fake news and the loss of jobs around the world. ChatGPT, a large-language model generative AI, exemplifies these challenges.

This will discuss the copyright implications of ChatGPT’s output under Australian law. It will be seen that originality and authorship are the most contentious of the copyright subsistence criteria. Comparisons will be drawn between the copyright laws in Australia and the UK, and the differences will be highlighted. Amendments will be suggested for Australian copyright law to accommodate advancements in AI. The presentation will underscore the need for a robust copyright regime, which has the capacity to adapt to the transformative potential of AI, while maintaining a balance between fostering innovation and safeguarding creators’ rights.
